SAINT-CYRILLE-DE-WENDOVER · EB-5 FIELD GUIDE

The sponsor says job creation is their problem, not mine — is that right for an EB-5 from Saint-Cyrille-de-Wendover?

THE DIRECT ANSWER

No. The requirement of at least ten full-time jobs for qualifying U.S. workers attaches to each investor individually, and it is the investor who must eventually prove it when filing to remove conditions. A sponsor’s economic report is evidence you rely on, not a transfer of the obligation.

The obligation is yours even when the model is theirs

Read the offering the way an adjudicator will: how many jobs does the model produce in total, how many investors are being admitted, and what does that leave for each one. Hypothetical example: a subscriber to an American cold-storage development is told the sponsor’s economist has the job question covered; the model projects three hundred and twenty qualifying positions and the offering contemplates thirty-two investors, which leaves exactly ten each with no margin for a project that underperforms. Ask what happens if construction is delayed, whether the model relies on expenditure or on operational hiring, and whether any jobs are allocated to investors who have already exited.

There is a second obligation the same conversation should cover. Every investor must be engaged in the management or policy formulation of the enterprise, and a limited partnership interest carrying the rights ordinarily accorded limited partners can satisfy that, but a purely passive arrangement described as a loan generally cannot.
