✦ WORK.

BELONG.

A rural file usually arrives as one story. The farm, the numbered company, the person holding the passport and the people who would move with him are described together, because in daily life they are one operation. Each American route pulls that story apart in a different place. A professional engagement examines the individual and the duties he is hired to perform. A transfer examines two corporations and the relationship between them. An investment examines whose money it is and who controls the enterprise it buys. Getting a useful answer from Saint-Lucien starts by writing the same facts out three times, once per legal person, and seeing where the three versions disagree.

THERE’S MORE THAN ONE WAY FORWARD.

THE DREAM IS YOURS.
LET’S FIND THE WAY.

A licensed land surveyor, the production director of a substrate plant, a drainage contractor and a nurse working shifts at a long-term-care residence do not share a route, and the reason is not ambition or preparation. Each one has a different combination of citizenship, corporate structure, capital and family ages, and it is the combination that decides. Reading the six route pages beside one another shows which of those four things a category studies hard and which it does not look at once.

Before you accept an American offer

A professional engagement stands on two independent findings: that you qualify, and that the job is genuinely the profession it is named after.

YOU WEREN’T
MADE TO
THINK SMALL.

Two kinds of enquiry come from this part of the MRC de Drummond. In the first, someone already employed by a farm-service business, an aggregates operation, a food plant in the surrounding area or a health facility learns that an American company wants them, and the question turns on citizenship, credentials and the last three years of duties. In the second, someone who owns equipment, land or a small contracting business would rather own something on the other side, and the question turns on ownership percentages, the origin of the money and how many people the American business would employ. The routes that answer those two questions share almost no evidence.

01

Sort the file into three piles

One pile for the individual: passport, degrees, licences, and the actual work performed in each of the last three years. One pile for the corporations: incorporation documents, share registers, financial statements and any agreement linking a Canadian entity to an American one. One pile for the household: every traveller, their citizenship, their date of birth and what each of them intends to do after the move.

02

Ask which pile each route reads

TN reads the first pile almost exclusively and refuses self-employment in the United States. L-1 lives in the second pile and cannot proceed without a qualifying corporate relationship. E-2 needs the second and third piles together, since ownership percentages and who directs the business both matter. EB-5 wants a documented path for the money and ten jobs it will pay for.

03

Put a date on every fact

Categories are decided by dates more often than by descriptions. The continuous year of qualifying employment abroad is measured within the three years before a petition. A child stops being a derivative at twenty-one. Capital counts when it becomes irrevocable, not when it is promised. A provincial licence has an issue date and an expiry date. Undated facts cannot be tested.

04

Bring the contradictions, not the summary

The useful remote conversation is about the four or five points where the three piles contradict each other: a title that does not match the duties, a shareholder nobody recorded, a transfer between accounts with no explanation, a birthday that lands mid-process. Those points are what a specialist can move. A tidy narrative that hides them wastes the appointment.

A LITTLE CLARITY GOES A LONG WAY.

YOUR FUTURE.
NOW BOARDING.

The six route pages and the seven guides are each built on a different situation, so the same federal rules can be watched applying to different facts: a surveyor whose credential is fine but whose licence is not, a specialist who would spend most weeks on somebody else’s farm, an investor whose American partner wants an equal share, a household with one child turning twenty-one and another already past it. Read whichever is closest to your own circumstances and pay attention to where it diverges, because the divergence is the part worth an adviser’s time.

SUPPORT THAT REACHES YOU.
A BIGGER HORIZON.

Enquiries from Saint-Lucien are handled remotely by Shneur Herman, founder and senior consultant, Jo Kubti, chief executive, and Alexander Paton, immigration specialist. There is no local office and no address in the municipality, so nothing here should be read as an invitation to an in-person meeting. A first conversation is used to organize facts, identify gaps and separate what is settled from what is still being negotiated. Where a filing is to be made, a licensed United States immigration attorney takes it on. Everything published on this site is general information about federal requirements rather than legal advice.

BEFORE THE BIG MOVE

LET’S CLEAR
A FEW THINGS UP.

I farm here and my brother would manage the American operation. Whose route is whose?

They are two separate assessments that happen to share a business plan. Whoever performs work inside the United States needs a basis for that work in their own name, decided by their own citizenship, credentials and role. A sibling who stays in Quebec and holds shares is an owner, not an applicant. Where one person invests and another manages, an investment route looks closely at whether the investor genuinely develops and directs the enterprise, because passive ownership does not satisfy that requirement.

My accountant wants the Quebec company to own the American business. Does that structure help?

It changes which route is available rather than making any of them easier. A treaty investment can be held through a corporation, but the enterprise must be at least fifty per cent owned by treaty nationals, so the shareholders behind the corporation are traced. An intracompany transfer needs a qualifying parent, branch, subsidiary or affiliate relationship and both entities actively doing business. Choosing the structure before choosing the route usually means rebuilding it afterwards.

I have run this business for eleven years but paid myself through my own numbered company. Is that a qualifying year?

It has to be examined rather than assumed. An L petition requires one continuous year of qualifying employment with the foreign entity within the three years before filing, and invoicing an operating company through a separate personal corporation can make the employment relationship hard to demonstrate. Payroll records, T4 slips, a written employment agreement and directors’ resolutions are the evidence that settles it. Where the record is genuinely ambiguous, that ambiguity is worth resolving before anyone drafts a job description.

Can we meet somewhere in Saint-Lucien?

No. There is no office in this municipality, none in the surrounding MRC and no in-person appointment anywhere in this coverage area; every consultation is remote. Shneur Herman, Jo Kubti and Alexander Paton answer enquiries that way, and a licensed United States immigration attorney takes carriage of any formal filing.
