L-1B exists for a transferee whose knowledge is special to the petitioning organization — its own product, its own process, its own equipment or techniques, or an advanced level of knowledge of how that particular company does things. The classification shares the L framework: a qualifying parent, branch, subsidiary or affiliate relationship with both entities genuinely doing business, and one continuous year of qualifying employment abroad within the three years before the petition. Hypothetical example: Térence developed and now runs the two-component pour-in-place foaming line at a Saint-Cyrille-de-Wendover insulated-panel manufacturer, including the chemical dosing recipe and the mould-heating sequence the company wrote itself; the group wants him at its Kentucky affiliate for three years, working partly at the affiliate’s plant and partly at a customer’s site during commissioning. The petition has to establish both that his knowledge is company-specific and that the offsite portion stays under the petitioner’s control.

IN THIS GUIDE · L-1B from Saint-Cyrille-de-Wendover: knowledge that belongs to your employer, not to your trade

Start with the L-1B eligibility and application overview

01

Special to the company, not merely rare in the market

The statutory test is knowledge of the petitioning organization’s product, service, research, equipment, techniques, management or other interests and its application in international markets, or an advanced level of knowledge of the organization’s processes and procedures. Two words carry the weight: the knowledge must be of the organization. Deep skill in a widely sold platform, however scarce good practitioners may be, generally belongs to the industry rather than to the employer, and vendor training certificates argue against the petition as often as for it. What builds the case is material the company itself generated: internal specifications, recipes, calibration standards, development records, the record of who wrote a procedure and when. If a competitor could hire the same expertise from the open market, say so internally and reconsider the classification before filing.

02

The offsite restriction, in plain terms

Where an L-1B beneficiary will be stationed primarily at the worksite of an employer other than the petitioner or its affiliate, the petition fails if the beneficiary will be controlled and supervised principally by that other employer, or if the placement is essentially an arrangement to provide labour for hire rather than work requiring the specialized knowledge. Commissioning, installation and training visits are ordinarily fine; being placed with a client for years, taking daily direction from that client’s supervisors, is not. The evidence that answers this is contractual and organizational: who assigns the tasks, who signs the performance reviews, who bears responsibility for the deliverable, and whether the work at the client site is itself the specialized work. Describe the split of time honestly, because a vague answer here invites a request for evidence at the least convenient moment.

03

Building the evidence file before anyone drafts a letter

The most common weakness is a petition supported by assertion. A two-page résumé and a covering letter calling someone indispensable proves nothing. What persuades is a paper trail: dated internal training records, the specification the beneficiary authored, revision histories showing his changes, project reports, the internal manual only employees see, and a comparison of what the company would have to do without him. Where the knowledge is protected, provide a description sufficient to establish its nature without publishing the trade secret itself. It also helps to explain, factually, how long it took the company to train him and why that period cannot simply be repeated with a local hire on the required schedule — expressed as facts rather than as adjectives.

04

Ceiling, family, and the practical planning window

L-1B is limited to a maximum of five years, two fewer than the managerial classification, and there is no route to extend beyond it inside the category. Recapture of time spent physically outside the United States is generally available with travel records. Because five years passes quickly on a long industrial project, it is worth deciding at the outset whether the assignment realistically ends inside the ceiling or whether a different plan is required. The spouse of an L-1B principal holds L-2 status and is employment-authorized incident to that status, so the spouse may work for any employer, subject always to whatever professional licence the occupation itself requires. Unmarried children under 21 accompany and may study; a child ageing past 21 is no longer a derivative.
