Eligible dependants may seek L-2 status. A qualifying L-2 spouse may be authorized to work incident to status, while children may study but do not gain that same employment privilege.
Avoid treating L-2 as one uniform permission
Hypothetical example: a specialist’s spouse plans freelance work and a child plans high school. Check the spouse’s admission documentation and evidence of the relationship before relying on work authorization. The child’s enrolment is a different question and does not create employment permission.
Passports, civil records and expiry dates should be tracked with the principal’s L-1B validity. Gather marriage or birth certificates, passports and I-94 records for every spouse or child seeking L-2 status. Coordinate the principal’s five-year maximum and current petition period with the spouse’s freelance start, the child’s school calendar and all status expirations.
Correct relationship-document variations and admission-class errors before the spouse relies on incident-to-status employment authorization. An L-2 spouse may work incident to status, but the child must not treat school admission as work permission. Confirm each family member’s classification and validity independently, including the principal’s L-1B end date and the unmarried child’s approach to age twenty-one.
Confirm the dependent’s passport, relationship evidence, status record and intended daily activity independently. A family may share a move, but immigration permissions are not automatically shared in the same way. Update the review if employment, school or age facts change.
Check the final record again if an event changes the facts before action is taken.
