A Drummondville L-1B employee should show the qualifying specialized knowledge they personally possess and how the U.S. assignment uses it. Sharing processes between related operations is context, not automatic eligibility. The qualifying relationship, foreign employment and actual placement remain essential. A useful L-1B specialized-knowledge transfer review begins with a fact matrix rather than a preferred answer. List the person, employer or enterprise, authority, place of activity, dates, money or compensation, and the record supporting each item. The first pass should identify the legal question that each record can actually settle, then flag gaps that require an original, a translation, or a clearer explanation. The transfer normally calls for a full qualifying year with the related foreign organization during the three-year lookback. L-1B time has a five-year aggregate ceiling, and a new office needs premises plus ability to pay the worker and start business operations. The key decision is whether the current arrangement fits this route as it now exists, not whether a future version might become stronger. Keep a chronology that distinguishes completed steps from planned steps, and revisit it before travel, a filing, payment, or a change in duties. This method also prevents a polished business narrative from hiding an unsupported element.

IN THIS GUIDE · Explain knowledge shared between related operations

01

Identify the individual knowledge transfer

Hypothetical example: an employee who adapted an internal process abroad will help a related U.S. team apply it. Describe what was learned, the employee’s contribution and the specific U.S. work. Do not attribute all organizational expertise to the applicant without evidence. Trace the order of events: record the original plan, the decision-maker, and the date on which an obligation became binding. That sequence often exposes whether a later explanation describes a fact or an aspiration.

02

Use the specialized-knowledge standard

Assess special knowledge of the organization’s products, services or related interests and international application, or advanced knowledge of its processes and procedures. The knowledge need not universally be unique or secret. A generic claim of industry experience does not explain the required individual knowledge. Test labels against evidence. Job titles, corporate descriptions, and sales language are useful starting points, but the underlying duties, authority, and transaction records resolve the legal question.

03

Connect history with authentic records

Use relevant training, projects and employment evidence to show acquisition and application. Keep planned future learning separate from completed experience. Document the qualifying company relationship and required foreign employment rather than assuming a shared brand proves both. Use originals that can be dated and connected to a person or entity. A chronology should identify gaps, translations, and documents that contradict the preferred narrative before anything is submitted.

04

Examine the actual U.S. working conditions

Identify duties and supervision. Principal placement at an unaffiliated employer’s worksite requires review of control and supervision and whether it is labour for hire rather than a qualifying product-or-service placement requiring the petitioning employer’s specialized knowledge. A process-transfer label does not decide the placement question. Separate a future forecast from current proof. A business plan, anticipated hire, or intended assignment may matter, yet it cannot silently become evidence that the fact already exists.

05

Complete the foreign-employment and new-office assessment

L-1B generally requires one continuous qualifying year of foreign employment within the relevant preceding three-year period, along with qualifying organizations that meet the doing-business requirements. Assess actual dates and locations; U.S. days do not count toward the foreign year. For a U.S. organization doing business for less than one year, the L-1B new-office evidence includes sufficient premises and financial ability to pay the employee and begin doing business. Initial new-office approval is limited to at most one year. L-1B status is capped at five years. Finish with a decision record stating what is established, what remains conditional, and what must happen before the next immigration step. That record prevents a commercial deadline from dictating an unsupported filing position.
