WICKHAM · GOLD CARD FIELD GUIDE

Does a Gold Card let a Wickham owner work for any U.S. employer?

THE DIRECT ANSWER

No. The programme operates through existing employment-based immigrant classifications and a vetting process, so the requirements of whichever classification is used still apply. The payment does not create eligibility, does not replace an employer where one is required, and is not a work permit in itself.

Payment does not substitute for a classification

Hypothetical example: Ursule is told that once the payment is made she may take a job with whichever American employer she chooses. That is a description of something the programme is not. The Gold Card framework uses employment-based immigrant classifications that already exist, principally EB-1 and EB-2, together with vetting, rather than creating a new category with its own rules.

Whatever the chosen classification requires of an applicant, it continues to require, and the ordinary grounds of inadmissibility continue to apply. So the first question Ursule should ask is which classification is proposed for her and why she fits it. If the answer is vague, the file has not been analysed.

It is also worth being clear about what this is not: it is not EB-5, there is no investment, no enterprise and no job creation requirement, and the money is a gift to the U.S. government rather than capital that might one day come back.
