The corporate relationship can be established quickly, but two other requirements are not so quick. She must show one continuous year of qualifying employment with the foreign employer within the three years before the petition, and both companies must be doing business. An American plant that has not operated since closing puts the second of those in doubt.
Three findings, and the newest one is the fragile one
Ownership is the easy part: a purchase agreement and an updated share register can demonstrate a parent, branch, subsidiary or affiliate relationship the day after closing. The qualifying year is a matter of record, and nine years with the Quebec processor comfortably contains twelve unbroken months inside the relevant three-year window, provided the employment was with the entity that is actually part of the group. Doing business is where a recent acquisition strains.
The requirement contemplates the regular and continuous provision of goods or services, and an idle plant provides none. Restarting production before filing, even at reduced volume, changes the answer far more effectively than any argument about intent. Where a restart cannot happen first, the alternative is to treat the American entity as a new office and accept the one-year initial approval and the evidence that comes with it, rather than claiming an operating business that does not yet exist.
