FOR SPECIALIST TEAMS · SAINT-LUCIENSaint-Lucien

Your expertise.Across borders.

Hypothetical example: Damien works for a Saint-Lucien firm that designs, builds and then operates on-farm anaerobic digesters, turning manure and food-processing residues into gas. For six years he has looked after the company’s own feedstock recipes and the control logic that keeps a digester stable when the input changes, both of which the firm developed itself and treats as confidential. An affiliate in the American dairy belt wants him for commissioning work. The complication is geography of a particular kind: almost none of that work would take place at the affiliate’s premises, because digesters sit on the farms that own them.

Start with the L-1B eligibility and application overview

01

Specialized knowledge belongs to the company, not to the discipline

The classification reaches knowledge of the petitioning organization’s own product, service, research, equipment, techniques, management or procedures, or an advanced level of knowledge of its processes. Being an unusually capable process engineer is not the test, however true it is. What counts for Damien is the part of his work that could only have been learned inside this firm: the recipe library built from its own failures, the control parameters tuned across its installed base, the troubleshooting sequence that exists nowhere in the published literature. The line to watch is whether a competent person hired from the industry could do the job after a normal handover. If the honest answer is yes, the file is describing a good employee rather than a specialized one.

02

Where he will be standing changes the analysis

Placement primarily at worksites belonging to companies unrelated to the employer brings a further requirement into play. The work has to remain controlled and supervised by the petitioning employer, and the arrangement must not amount to providing labour for hire to the site owner. Commissioning a digester on a farm that has bought one from the affiliate can satisfy that, because the farm is buying an installed system rather than renting a technician. It fails where the affiliate effectively seconds Damien to the farm’s own maintenance department, where the farm directs his day, or where his time is billed as hours supplied. The commercial paperwork tends to reveal which of these it is long before anyone asks.

03

Control is demonstrated by the contract, the reporting line and the invoice

Intentions do not travel well into a petition. Three ordinary business documents carry this point better than any assurance. The contract between the affiliate and the farm should describe a system delivered and commissioned to a specification, with the affiliate responsible for the result. The reporting line should show Damien answering to a named supervisor within the affiliate, who assigns his work and evaluates it. The invoice should be for the installation and its commissioning rather than for days of labour. Where all three point the same way, the arrangement explains itself; where they contradict each other, the contradiction is the finding.

04

A five-year ceiling spent on other companies’ start-ups

This classification permits a maximum of five years, and the qualifying year abroad still applies: one continuous year of employment with the foreign entity within the three years before the petition, in a role that itself involved the specialized knowledge. It is worth asking what those five years are for. Commissioning is finite work, and a specialist who spends them stabilising one farm after another will end the period with nothing that converts into a longer plan. Employers that think ahead use part of the time to transfer the knowledge deliberately, training American staff and documenting the recipes, which is also the most persuasive evidence that the knowledge was specialized in the first place.
