The removal-of-conditions request is generally filed during the 90 days immediately before the second anniversary of obtaining conditional permanent residence.
Prepare the I-829 record from the beginning
Hypothetical example: an investor becomes a conditional resident after an EB-5 approval and stores project documents in several unrelated places. Keep investment and job-creation evidence organized throughout the conditional period. The I-829 filing window is tied to the second anniversary of conditional residence, not merely the earlier petition approval date.
Maintain dated investment, deployment and job records from the EB-5 petition filing (I-526 or I-526E) through conditional residence and the later I-829 stage. Calendar petition events, visa processing or adjustment, the conditional-residence start date and the ninety-day I-829 window preceding its second anniversary. Resolve project reports or residence records that conflict on when conditions began or whether job creation occurred.
Do not wait for the second anniversary before assembling the I-829 evidence. Track the sequence from the EB-5 petition (I-526 or I-526E) through two-year conditional residence to I-829, while coordinating derivative status, travel and evidence addressing the required investment and job creation. Use a written calendar for petition validity, status expiry, school dates, travel, planned work and any payment deadline.
If a new fact moves one date, reconsider the sequence instead of treating the original plan as fixed. Timing evidence should support, not outrun, the authorization sought. Check the final record again if an event changes the facts before action is taken.
