Can the spouse of a Notre-Dame-du-Bon-Conseil E-2 investor take employment?

THE DIRECT ANSWER

A qualifying E-2 spouse may have employment authorization incident to status, while dependent children may study but do not obtain the same work permission.

Keep investment and family files separate

Hypothetical example: an investor’s spouse has an offer from an unrelated U.S. employer and their child is finishing secondary school. Check the spouse’s status evidence before the job begins, and build the child’s school plan around the child’s dependent status and age.

The investor’s business ownership does not transfer employment authority to each family member. Retain marriage and birth certificates, passports and E-status admission records for the investor, spouse and school-age child. Align the investor’s E-2 validity with the spouse’s offered start date, the child’s graduation and every family member’s passport and I-94 expiry.

Correct any relationship, nationality or admission-record inconsistency before the spouse accepts the unrelated employer’s offer. The E-2 spouse may work incident to status; the dependent child has no corresponding employment authorization. Confirm the principal maintains E-2 eligibility, the spouse holds the proper dependent classification and any unmarried child remains under twenty-one throughout the planned stay.

Confirm the dependent’s passport, relationship evidence, status record and intended daily activity independently. A family may share a move, but immigration permissions are not automatically shared in the same way. Update the review if employment, school or age facts change.

Check the final record again if an event changes the facts before action is taken.
