Start with the L-1B eligibility and application overview
Company knowledge and industry skill look identical until you ask who could replace him
The category reaches knowledge of the petitioning organization's own product, service, research, equipment, techniques, management or procedures, or an advanced level of knowledge of its processes. It does not reach general expertise, however deep, that a competent professional in the same field would also hold. The question that separates them is practical: if Thanh left tomorrow, could the company hire a replacement who would be productive without being taught something only this company knows? Where the answer is yes after a few weeks of ordinary onboarding, the knowledge is industry skill. Where the answer requires access to an internal formulation, an unpublished protocol or years inside a proprietary system, it is specialized. The substrate formulation and the climate recipe point the right way, and the file should be built around those rather than around his general horticultural competence.
Working at a customer's site is allowed, and it is where petitions fail
Placement primarily at the worksite of an unaffiliated company is permitted only on conditions. The transferee must not be controlled and supervised principally by that other company, and the arrangement must not amount to providing labour for hire rather than services connected to the petitioner's own specialized knowledge. Applied to this plan, the supply agreement should make clear that the nursery is delivering an outcome using its own methods, that Thanh reports to the nursery's own management, that the grower cannot direct or discipline him, and that he is not filling a staffing gap the grower would otherwise hire for. Where the contract reads as a body being supplied by the hour, no amount of technical detail about the substrate will save it, so the commercial paperwork should be reviewed before the petition is drafted.
The corporate half is the same test the manager faces, with the same traps
Specialized knowledge does not remove the structural requirements. There must be a qualifying parent, branch, subsidiary or affiliate relationship between the nursery and the American company, evidenced by ownership records rather than asserted, and both entities must be doing business. Thanh must also have one continuous year of employment with the group outside the United States within the three years before filing, in a specialized-knowledge, managerial or executive capacity. Eleven years at the nursery makes that year easy to satisfy but not automatically easy to prove, particularly if his role changed titles along the way. Where the American entity has been trading for under a year, the new-office rules apply and the initial period granted is one year, which for a specialized-knowledge transferee compresses an assignment that was planned around a longer stay.
Five years is the ceiling, and it starts sooner than people think
Time in specialized-knowledge status is limited to a maximum of five years, against seven for a manager or executive, and periods already spent in the United States in an L or H category generally count toward it. That ceiling shapes planning in two ways. A two-year assignment followed by an extension leaves little room for a further project later, so a company that expects a long American presence should ask early what comes after the fifth year rather than treating the question as a renewal problem. And where the knowledge has genuinely become managerial over time, a later petition in the executive or managerial category is a different filing with a different evidentiary burden, not a reclassification of the existing one. Neither point is urgent at the start, and both are cheaper to plan for then.
