Read the general immigrant investor briefing overview
Hypothetical example: Yolande harvests and blends horticultural peat and growing media near Saint-Majorique-de-Grantham and has capital from a long-running business she is winding down. Her accountant has asked a blunt question: what does each of these two routes actually require her to demonstrate, and what happens to the money in each case. Setting the marketing aside, the two demand almost opposite kinds of proof, and only one of them leaves anything that can be recovered.
The investor route is an evidentiary project about a business
It requires qualifying capital of one million and fifty thousand United States dollars, or eight hundred thousand for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning on the first of January 2027, placed at risk in an enterprise that creates at least ten full-time positions for qualifying employees. It requires the lawful source and the path of the funds to be documented, and the investor to be engaged through management or policy formulation. Residence is granted conditionally for two years, and Form I-829 is generally filed in the ninety days before the second anniversary to remove those conditions.
The Gold Card framework is a vetting exercise about a person
As the official material describes it, the applicant pays a nonrefundable processing fee of fifteen thousand United States dollars per person and is vetted, and on success makes a gift of one million dollars to the U.S. government, or two million where a corporate sponsor gives in respect of an employee, with a further fee and a further million for each accompanying spouse or unmarried child under twenty-one. Successful applicants proceed through the existing first or second employment-based preference classifications, subject to eligibility, admissibility and visa availability. Nothing is invested, no jobs are required, and nothing is returned. It should never be described as an investment, and the current terms should be re-verified officially before any money moves.
What each one leaves behind if it goes wrong
Under the investor route the capital is at risk commercially, which means it can be lost in the ordinary way a business is lost, but it is invested in something with assets, accounts and a value. If the petition to remove conditions fails, the investment may still exist even where the status does not. Under the gift framework the money is gone on payment and there is nothing to recover if a later stage does not succeed. Neither route buys status, and neither should be chosen on speed. Before committing to either, Yolande should have a licensed United States immigration attorney confirm the current terms, the current amounts and her own admissibility.
