Drummondville guide: compare a company transfer with a separate investment

USAvisa field guide · 3 minute read Reviewed 7 September 2026
THE SHORT ANSWER

A founder may consider a related-company transfer and a personal acquisition at the same time. Keep their entity relationships, duties and funding separate so each possible route is assessed on a proposal that actually exists. Use this guide as a decision tool for the L-1 versus E-2 route choice, not as a checklist that supplies a conclusion by itself. Start with a dated table of the parties, ownership or family links, proposed activity, money, locations, and the document supporting each item. The first review should produce a timeline, a list of unresolved assumptions, and a short statement of the decision the reader must make before taking the next step. Hypothetical example: a founder of a precision beekeeping-sensor company can transfer through a related entity or personally buy a separate U.S. pollination-service business. The reader must decide whether the presently documented arrangement fits the selected route, or whether the facts point to a different route or a pause for more evidence. Place original records before summaries, identify who had authority to make each commitment, and separate completed transactions from future plans. L-1 depends on related active organizations and qualifying employment, while E-2 depends on treaty nationality, committed capital, and the investor's direction of a real nonmarginal enterprise. A favourable label, a letter of intent, or a commercial deadline cannot replace the condition that governs the route. Recheck the analysis when any material fact changes. Keep a decision memo identifying the last verified fact, the next required record, and the event that would require the reader to stop and reassess.

01

Describe the two arrangements independently

Hypothetical example: the Canadian company plans a U.S. operation while its founder considers buying another enterprise. Identify the employer, owners, role and capital for each. Do not borrow the transfer’s company relationship or the acquisition’s personal funds to create a combined story unsupported by either arrangement. Make the reader choose between the records that prove the present fact and the materials that merely predict a later event.

02

Test the different requirements

L-1 requires one continuous qualifying year abroad within the prior three years, a parent, branch, subsidiary or affiliate relationship with both entities actively doing business, and actual managerial or executive duties for L-1A or company-specific specialized knowledge for L-1B. A new office receives at most one initial year; any principal offsite placement must not be labour for hire and must remain controlled by the petitioner. L-1A is capped at seven years and L-1B at five. E-2 requires treaty nationality for the investor and enterprise, substantial funds irrevocably committed and at risk, and a real nonmarginal enterprise the applicant will develop and direct, ordinarily through at least 50% ownership or operational control. E-2 has no direct path to permanent residence. Where two explanations compete, preserve the document created closest to the event and explain the discrepancy rather than smoothing it over.

03

Include continuing duties and family plans

Identify Canadian responsibilities the applicant intends to retain and where they will be performed. Review spouse work and children’s study separately. Qualifying E and L spouses may be employment-authorized incident to status with appropriate documentation; children do not gain work permission solely through dependent status. Assess the complete selected arrangement before commitments depend on it. Before acting, state the concrete decision, the missing condition, and the next record needed to resolve it.
