Drummondville L-1 guide: explain what continues abroad during the launch

USAvisa field guide · 3 minute read Reviewed 7 September 2026
THE SHORT ANSWER

A U.S. launch plan should explain continuing foreign operations and the transferee’s actual duties. A cross-border oversight title does not establish the qualifying relationship, employment history or the particular L-1A or L-1B new-office requirements. Use this guide as a decision tool for the L-1 new-office choice, not as a checklist that supplies a conclusion by itself. Start with a dated table of the parties, ownership or family links, proposed activity, money, locations, and the document supporting each item. The first review should produce a timeline, a list of unresolved assumptions, and a short statement of the decision the reader must make before taking the next step. Hypothetical example: a company that produces marine-navigation training simulators leases a suite before it has hired the operational team described in its plan. The reader must decide whether the presently documented arrangement fits the selected route, or whether the facts point to a different route or a pause for more evidence. Place original records before summaries, identify who had authority to make each commitment, and separate completed transactions from future plans. A new-office proposal must match the specific L-1A or L-1B role, the foreign employment history, the qualifying organization, and the proof appropriate to its stage. A favourable label, a letter of intent, or a commercial deadline cannot replace the condition that governs the route. Recheck the analysis when any material fact changes. Keep a decision memo identifying the last verified fact, the next required record, and the event that would require the reader to stop and reassess.

01

Allocate continuing and new responsibilities

Hypothetical example: a manager retains selected Canadian decisions while leading the U.S. launch. Identify who performs operational work in each business and where the applicant intends to work. Document qualifying ownership or control and the relevant foreign employment. Mere registration does not establish doing business. Make the reader choose between the records that prove the present fact and the materials that merely predict a later event.

02

Apply the correct role-specific requirements

L-1A new-office review includes sufficient premises, required foreign managerial or executive employment and ability to support the intended managerial or executive role within one year of approval. L-1B requires specialized-knowledge assessment, premises and financial ability to pay the employee and begin doing business. Do not substitute a generic management forecast for a specialist’s analysis. Where two explanations compete, preserve the document created closest to the event and explain the discrepancy rather than smoothing it over.

03

Preserve the record as operations develop

The new-office framework concerns a U.S. organization doing business for less than one year, with initial approval limited to at most one year. Keep actual business, staffing and role evidence for later review. Any principal offsite placement must not be labour for hire, and the petitioner must retain control. L-1A status is capped at seven years and L-1B at five years. Continuing Canadian activity and an initial approval do not automatically establish every extension requirement or authorize materially different work. Before acting, state the concrete decision, the missing condition, and the next record needed to resolve it.
