A business-owning household should identify what each proposed payment represents before comparing residence strategies. Company operating reserves, EB-5 capital and Gold Card gift obligations are not interchangeable categories. Use this guide as a decision tool for the EB-5 and Gold Card funding choice, not as a checklist that supplies a conclusion by itself. Start with a dated table of the parties, ownership or family links, proposed activity, money, locations, and the document supporting each item. The first review should produce a timeline, a list of unresolved assumptions, and a short statement of the decision the reader must make before taking the next step. Hypothetical example: a producer of recycled musical-instrument cases has funds for a project subscription but receives a separate corporate proposal involving a gift payment. The reader must decide whether the presently documented arrangement fits the selected route, or whether the facts point to a different route or a pause for more evidence. Place original records before summaries, identify who had authority to make each commitment, and separate completed transactions from future plans. EB-5 uses qualifying at-risk capital, job creation, and conditional residence. Gold Card concerns the applicant's required payment to the U.S. government under the current official framework; it is not a conventional visa. A favourable label, a letter of intent, or a commercial deadline cannot replace the condition that governs the route. Recheck the analysis when any material fact changes. Keep a decision memo identifying the last verified fact, the next required record, and the event that would require the reader to stop and reassess.
Trace the actual EB-5 funding proposal
Hypothetical example: the owner preserves funds for Canadian operations while considering a personal investment. Identify lawful ownership, relevant distributions and the source and path of the actual capital. Review capital at risk, the current applicable threshold and qualifying jobs under the relevant structure and method, generally ten jobs. A company balance does not establish a completed personal investment. Make the reader choose between the records that prove the present fact and the materials that merely predict a later event.
Verify the separate official gift framework
Gold Card uses current official gift terms tied to EB-1 or EB-2 availability and applicable requirements, vetting and admissibility. Confirm the actual individual or corporate proposal and family obligations. Do not describe the gift as a recoverable EB-5 asset or assume a pending corporate change has already settled the payer arrangement. Where two explanations compete, preserve the document created closest to the event and explain the discrepancy rather than smoothing it over.
Compare individual outcomes beyond the funding plan
Separate fees, reserves, commercial risk and government process. Review family eligibility and age-related questions using actual facts. Financial capacity or a corporate closing does not guarantee approval, visa availability or a move date. Current permission governs present U.S. activities while the future residence proposal is assessed. Before acting, state the concrete decision, the missing condition, and the next record needed to resolve it.
Distinguish capital, official gifts and residence stages
EB-5’s September 7, 2026 capital minimums are US$1,050,000 or a qualifying US$800,000 for targeted employment area or infrastructure projects, with statutory adjustments starting January 1, 2027. The capital must have a lawful source and path, and the investor must engage in management or policy formulation. At least ten full-time jobs for qualifying U.S. workers are required. The petition is not residence; the investor, spouse and unmarried children under 21 may obtain two-year conditional permanent residence, followed by removal of conditions and the usual I-829 window in the 90 days before the second anniversary. Gold Card instead describes a nonrefundable US$15,000 fee per person and, after successful vetting and instructions, a government gift of US$1,000,000 individually or US$2,000,000 corporately. Each eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1,000,000. Confirm current corporate maintenance and transfer conditions separately, and re-verify all official Gold Card terms before any money moves. Neither framework guarantees eligibility, admissibility, visa availability or timing. A later stage may require its own proof, so retain the material that will explain how the facts developed after the first filing.
