Permanent residence is not citizenship: what a millwright with a PR card can and cannot use

THE SHORT ANSWER

Hypothetical example: Oleksandr is a millwright at a Saint-Germain-de-Grantham feed mill. He was born in Ukraine, has been a Canadian permanent resident for four years, and has been told by a colleague that his PR card lets him take a TN job in the United States the same way any Canadian can. It does not. TN eligibility runs on citizenship, and understanding why opens up the question of which routes actually remain available to him. The decision is whether a route fits the person’s actual citizenship now or whether another category is needed. A Canadian PR card remains useful context but cannot replace the TN nationality requirement.

01

TN is a citizenship rule, and it has no residence alternative

TN under USMCA is available to citizens of Canada and Mexico. Permanent residence in Canada, however long held and however settled the person is, does not satisfy that requirement, and there is no discretionary exception for length of residence, tax history or employment record. This surprises people because Canadian permanent residents are treated identically to citizens for most domestic purposes. The document that proves eligibility is a Canadian passport or citizenship certificate; a permanent resident card proves the opposite of what is needed. If citizenship is a realistic goal, the timing of naturalisation becomes a genuine planning input rather than a background fact. Hypothetical example: A single-origin tea wholesaler has Canadian PR and a listed-profession offer. Decide from the passport, not the PR card, whether TN citizenship exists today.

02

The routes that do not turn on nationality

The L categories contain no nationality requirement at all. If Oleksandr's employer had a qualifying corporate relationship with a United States entity, and if he had one continuous year of qualifying employment abroad within the preceding three years, his citizenship would not be the obstacle; his duties would decide whether L-1A or L-1B fits, and a millwright's role would have to be examined honestly against the specialized knowledge test rather than assumed to meet it. Employment-based immigrant categories likewise do not turn on Canadian citizenship. E-2, by contrast, does require treaty nationality, so it would depend on whether Ukraine is a treaty country for E-2 purposes, which has to be checked on the official treaty country list. Hypothetical example: An aerospace-composites quality inspector lacks treaty citizenship but works for a company expanding south. Decide whether corporate relationship and foreign service support L-1 instead of forcing a nationality-based category.

03

What changes on the day citizenship is granted, and what does not

Naturalisation opens TN and makes the person visa-exempt for several purposes, which is a real change. Two things do not change. First, the profession must still be one listed in Appendix 2 at the required qualification; millwright is a skilled trade rather than a listed profession, so citizenship alone would not create a TN route for that work. Second, family members hold their own statuses: a spouse who is not a Canadian citizen would need a TD visa issued by a consular post rather than presenting at a port of entry. Anyone planning around a naturalisation date should get the professional eligibility question answered first, because citizenship is worth little if the occupation is not on the list. Hypothetical example: A craft-malt equipment engineer expects citizenship soon but has an immediate start date. Decide whether the role can wait or another valid route must be assessed; an application receipt does not control TN eligibility.
